The medical errors that lead to breast cancer misdiagnosis are the obvious one, failure to properly interpret a mammogram, but then the others are failure to do a sonogram or an ultrasound, which is sometimes indicated. It may be failure to do a mammogram, which could have or should have been done, and wasn't done. Kidney Cancer is often a silent type of cancer, by the time the patient has symptoms it's often too late. But there are instances where there are symptoms that really would really require a work up that would lead to the diagnosis of the kidney cancer. Or, sometimes where somebody has a study for some other reason (a cat scan/ an MRI)and the doctor is not looking for kidney cancer, but it's right in those films and there missed. Often lung cancer is not symptomatic. That is, the patient doesn't show any signs or symptoms, often until it is too late. The chronic cough, the coughing of blood, and other symptoms. But screening x-rays often are and should be done. It's a standard of care in some instances, typically depending on the age of the person, the history of the person, the smoking history of the person, the family history of the person. And if the clinician, the doctor, doesn't do those screening x-rays, or if they're done, and the x-ray is overlooked, and there is a lesion there, then that will be the basis for a lawsuit. Pancreatic cancer in some instances can lead to lawsuits. In some instances the type of cancer is such that there really is nothing that can be done for it. In those instances, where the cancer is located in the particular portion of the pancreas, it is subject to what is known as a whipple procedure, a procedure where the pancreas is surgically addressed and the cancer is erraticated. And the timing of the diagnosis is critical in those instances. And if the doctor doesn't recognize the symptoms that the patient is having and act upon them, that often can lead to a lawsuit. What medical errors can lead to prostate cancer?

Prostate Cancer is a peculiar type of cancer, in that there are standard tests that are done. Screening tests to see whether there is an additional cancer. The PSA test, is the usual test there's a Pre-PSA test also done and there's a whole level of 4.0's the cut off point when caution needs to be exerted by the physician. And I've seen cases where the prostate has gone, the PSA has gone as high as 18 and the doctors for some reason just over look it and they don't see it. The report gets in the doctor's file. There are various types of skin cancer, squamous cell cancer, basal cell cancer, and melanoma. Melanoma is the most serious and if not picked up timely and treated, death is almost inevitable. And the clinician must appreciate a lesion that presents it's self under certain cicumstances and be sure to biopsy it and then even if surgery is done, to be sure that free margins are obtained and If they do excise that lesion, that they do get all of it and confirm pathologically that they have all of it. When these things don't happen, there's a very serious lawsuit that follows. What are some common examples of hospital negligence?

There are many incidences of hospital negligence in New York. I have a case where a nurse rather than giving medicine once a week, gave it once a day. That ended in the death of the patient. I have a case where a patient caught on fire in the operating room. There are instances where technicians don't act as they should. Or even in the emergency department, the doctors there are a function of the hospital and if there are errors in the emergency department ordinarily the hospital will be responsible for that. What is the statute of limitations on hospital negligence lawsuits?

The statute of limitations in hospital negligence is ordinarily 2-1/2 years for medical errors. There is an exception if it's a municipal hospital, in which event there is a 90-day time limit within which a claim has to be filed, a year and 90 days within which the suit has to be filed. And if the negligence really isn't malpractice but is ordinary negligence -- a slip on the floor or whatever -- then a 3-year statute of limitations would apply. I'm Steven North.
