Are car accidents on the rise in California?

The Roberts Law Firm

I wouldn't say that car accidents are on the rise. In fact, I think that there's more of a prevalence of people being more careful now. Particularly in California, they've recently passed a law that requires you to wear a headpiece when you use a phone, which I'm seeing a lot of drivers using. I understand that insurance companies are reporting that auto accidents are down because they're using a lot more driver safety programs, particularly with their newer drivers that are coming on to their programs. So, there's not an abundance of more accidents. I'm Jeff Roberts of the Roberts Law Firm, a full service, personal injury law firm in Southern California. Why do insurance companies limit payouts in car accidents?

Shandell, Blitz, Blitz & Ashley, LLP

Insurance companies try to limit their payouts in car accidents because they are much more interested in profits over people. Insurance companies have people on their payrolls just to protect their profits so that they can show their shareholders how much money they've made. As a plaintiff's personal injury lawyer, I'm more concerned for the person than the insurance companies' profits. And I'll make sure that you get the money that's due to you. Hallo. In Massachusetts we see more and more motorcycle accidents every year. Motorcycles have become much more popular, there are hundreds of thousands of them on the road. Especially with elderly people, they do not know you're there, and that's the cause of many of the accidents. I'm attorney Tom Kiley. Are accidents from auto defects common?

Thomas M. Kiley and Associates, LLP

Many times in auto accidents either the cause of the accident or the enhanced injury occurs as the result of the defective or faulty design of the vehicle itself. Unfortunately, most of the time that people are involved in single car accidents they have no idea the vehicle cause contributed to it. Many of these cases are never pursued. They never end up in the hands of lawyers. The thing to look for is, in SUVs, high center of gravity , the ability of the vehicle to roll over easily, such as the 15 passenger vans, failure of seatbelts, roof fall in event the vehicle rolls over, defective air bag - the air bag deploys but doesn't deploy at the appropriate time, protecting their occupant. I'm attorney Tom Kiley. I've been representing the seriously injured and their families in Massachussets for over three decades.

Are car accident lawsuits common in Massachusetts?

Thomas M. Kiley and Associates, LLP

"Many people who haven't been in car accidents think that if that happened to them, they're just going to call their insurance agent and that their car is going to be fixed, their medical bills are going to be paid, they're going to be paid for their time out of work, and they're going to be paid for the pain and suffering of this horrible experience that they've had. That's not the case. Insurance companies, they're in business to make a profit. They make a profit by paying as little as possible on your claim. The adjusters are trained to do this. Even with an experienced attorney involved, they still resist paying full value on claims. That's why many times these cases require being taken to court to hold the insurance company accountable to ensure that they pay full value for what happened to you. I'm attorney Tom Kiley, I've been representing the seriously injured, and their families, in Massachusetts for over three decades."

What are the most common injuries in a car accident?

Bisnar Chase LLP

The most common kind of automobile accident injury is a whiplash because the majority of auto accidents are rear end accidents. You get a whiplash from the spine being stretched and snapped. Generally, whiplash injuries are an insult to the spine. The really bad thing about a whiplash injury is it doesn't really show up how bad it is for years after the accident. Are accidents from tire defects still common?

Thomas M. Kiley and Associates, LLP

Tire defects are still a problem on roads in the United States today. They're hard to prevent against because tread separation just happens sometimes spontaneously. And no inspection of the tire by a lay person would really reveal that there's a risk of something happening. Once the tire fails, the vehicle is susceptible to going off the road, rolling over and causing serious, catastrophic injury to occupants or bystanders. I'm attorney Tom Kiley. I've been representing the seriously injured and their families in Massachusetts for over three decades.

Why are large passenger vans prone to accidents?

Thomas M. Kiley and Associates, LLP

The most dangerous vehicle in my experience on the road today is surprising to most people. It's a fifteen passenger van. It has a high center of gravity and once it's loaded up with people and equipment, its handling characteristics change and in bad weather or emergency maneuvers, it can fishtail and roll over. When it rolls over, because its structure is very weak, the roof collapses. When this happens, the injuries can be devastating especially with fifteen people. You have brain injuries, spinal cord injuries, paralysis and death. Most people don't realize it - these vans are out they're. They're used by schools, sports teams, hotels, livery services. People ride in them every day and they're completely unaware of the magnitude of the injuries that can occur in one of these vans. I'm attorney Tom Kiley. I've been representing the seriously injured and their families in Massachusetts for over three decades.

Are car accidents on the rise in New York?

Proner & Proner

With increased traffic you're going to have increased motor vehicles accidents. And that certainly is a significant factor and has continued with increased motor vehicle accidents probably since motor vehicles were on the streets since horse and buggy days. Nonetheless, the increase is not statistically significant for the last five to ten years. And additionally, thankfully, motor vehicles are getting safer with airbags and safety restraint systems. So even though there may be an increase in motor vehicles accidents, there's a decrease in significant injuries. Which is lucky. I's Mitchell Proner. Are lawsuits from car accidents on the rise in New York?

Proner & Proner

Car accident lawsuits are actually decreasing in New York state statically from the court administration statistics. And, that's probably a good thing, it means, because in the simple fender bender, there's less injuries because of restraint systems and air bags. However, if somebody is going fast, and they do sustain catastrophic injuries, more likely than not there needs to be a lawsuit for the individual injured in that accident to get fair compensation for the injuries sustained. How severe are typical motorcycle accident injuries?

Bisnar Chase LLP

Motorcycle accidents result in much bigger injuries than car to car accidents because the motorcyclist is exposed. It is not uncommon to see major broken bones, head injuries, brain injuries, paralysis. Motorcycle accidents are a challenge not only for the injured person but for the attorney representing them because there is also a natural bias in the juries and in insurance companies against motorcyclists. To recover money, do I need to sue after an auto accident?

Bisnar Chase LLP

Most people that have been injured in an automobile accident do not technically sue. If they are injured, they make a claim and there is a difference between a claim and a lawsuit. A claim is you present a claim to the insurance company and you work out a hopefully fair settlement. If you don't work out a fair settlement, if you don't get the money that you believe you are entitled to, that's when you go to a lawsuit. And lawsuits on personal injury accidents on auto accidents in California have been declining every year for the last ten to fifteen years. I'm John Bisnar the senior partner of the Bisnar/Chase Law Firm. We exclusively represent seriously injured accident victims from our offices in New Port Beach California.

Should I handle my own auto accident claim in California?

Bisnar Chase LLP

People who are involved in auto accidents can handle their own claims. It’s kind of like, can you handle your own injury? Well if your injury is a scratched leg, you can put some antiseptic on it and a band-aid. But if you got a broken leg that needs to be set, I don’t think that’s the kind you want to handle yourself. Same thing with auto accidents – the more serious the accident, the more you’re going to need professional help. I’m John Bisnar, the senior partner of the Bisnar Chase Law Firm. We exclusively represent seriously injured accident victims, from our offices in Newport Beach, California.

The potential recovery for victims of motorcycle accidents is pretty much the same as victims of automobile accidents. You can recover your medical expenses, your loss/earning capacity, uh, any disfigurement, loss of enjoyment of life, payment for any permanency that your injuries may have. But again, it may be limited, by the insurance policy that’s held by the car that hit you. I’m attorney Tom Kiley.
