Medical malpractice occurs for various reasons. One of the most common reasons is that people are treated in hospitals by physicians who are early in their training, and are actually learning while they are treating the patients and learning on the patients. Experienced doctors, attending physicians, physicians with years of practice frequently aren't present when the most injured, most seriously ill people arrive at hospitals. Why does medical malpractice occur?

Steven E. North

Medical malpractice occurs because it simply is negligence or carelessness by somebody. Just as, why do automobile accidents happen? They'll always happen. They're not going to go away. Someday, someone will go through a stop sign. Someday, some doctor will go through a "surgical" stop sign or will fail to do something. It doesn't mean he's a good or bad doctor - it means it was a bad day, certainly a bad day for the patient. My name is Steve North. I specialize in medical malpractice litigation. When should I consult an attorney if I suspect malpractice?

Steven E. North

If someone suspects that there is a medical malpractice case, it's important that they contact an attorney promptly. The reason for that are multifold. One is a statute of limitations, a time limit in which a lawsuit has to be brought. And some of those time limits are very short. If municipalities are involved it's as short as three months within a claim has to be filed. It's also important to get involved early to obtain the medical records before they are potentially changed or altered. So the earlier the better is the general rule. There used to be many more losses involving anesthesia malpractice. It seems like there are fewer and fewer, and I’m happy to see and know that. There are still instances of failure to properly monitor during the course of the surgery. There are other instances where anesthesiologists venture into the realm of pain management. And they do procedures with regard to the spine, mylography and other such procedures that can cause nerve damage – serious nerve damage. And that’s another aspect of anesthesia malpractice that results in litigation. I’m Steven North, I specialize in medical malpractice litigation. Can I sue in New York if my cancer diagnosis was delayed?

Steven E. North

A delay in diagnosis in cancer is often the basis of a cancer medical malpractice lawsuit but there are two very significant elements to a medical malpractice case. One is that the doctor missed the boat, so to speak. The other element is that it made a difference, that it had an impact on the patient's course. So if a patient goes to Doctor A on one day and he doesn't pick up the cancer but goes to another doctor the next day and it's very obvious, there's really no damage that results from it. And it's the damage that's the controlling factor. I'm Steven North. I specialize in medical malpractice litigation. My office is located in a townhouse in the upper east side of Manhattan. What medical errors can lead to kidney cancer?

Steven E. North

Kidney Cancer is often a silent type of cancer, by the time the patient has symptoms it's often too late. But there are instances where there are symptoms that really would really require a work up that would lead to the diagnosis of the kidney cancer. Or, sometimes where somebody has a study for some other reason (a cat scan/ an MRI)and the doctor is not looking for kidney cancer, but it's right in those films and there missed. That often leads to law suits. I'm Steven North, I specialize in medical malpractice litigation, my office is located in a town house on the Upper East Side of Manhattan, we welcome your call.

What medical errors can lead to pancreatic cancer?

Steven E. North

Pancreatic cancer in some instances can lead to lawsuits. In some instances the type of cancer is such that there really is nothing that can be done for it. In those instances, where the cancer is located in the particular portion of the pancreas, it is subject to what is known as a whipple procedure, a procedure where the pancreas is surgically addressed and the cancer is erraticated. And the timing of the diagnosis is critical in those instances. And if the doctor doesn't recognize the symptoms that the patient is having and act upon them, that often can lead to a lawsuit. I'm Steven North. I specialize in medical malpractice litigation. My office is located in a townhouse in the upper eastside of Manhattan. We welcome your call.

What medical errors can lead to skin cancer?

Steven E. North

There are various types of skin cancer, squamous cell cancer, basal cell cancer, and melanoma. Melanoma is the most serious and if not picked up timely and treated, death is almost inevitable. And the clinician must appreciate a lesion that presents it's self under certain cicumstances and be sure to biopsy it and then even if surgery is done, to be sure that free margins are obtained and If they do excise that lesion, that they do get all of it and confirm pathologically that they have all of it. When these things don't happen, there's a very serious lawsuit that follows. I'm Stephen North, I specialize in medical malpractice litigation, my office is located in a townhouse in the upper east side of manhattan. We welcome your call.

What medical errors can lead to lung cancer?

Steven E. North

Often lung cancer is not symptomatic. That is, the patient doesn't show any signs or symptoms, often until it is too late. The chronic cough, the coughing of blood, and other symptoms. But screening x-rays often are and should be done. It's a standard of care in some instances, typically depending on the age of the person, the history of the person, the smoking history of the person, the family history of the person. And if the clinician, the doctor, doesn't do those screening x-rays, or if they're done, and the x-ray is overlooked, and there is a lesion there, then that will be the basis for a lawsuit. I'm Steven North. I specialize in medical malpractice litigation. My office is located in a townhouse in the upper east side of Manhattan. We welcome your call.

What medical errors can lead to prostate cancer?

Steven E. North

Prostate Cancer is a peculiar type of cancer, in that there are standard tests that are done. Screening tests to see whether there is an additional cancer. The PSA test, is the usual test there's a Pre-PSA test also done and there's a whole level of 4.0's the cut off point when caution needs to be exerted by the physician. And I've seen cases where the prostate has gone, the PSA has gone as high as 18 and the doctors for some reason just over look it and they don't see it. The report gets in the doctor's file. The patient is never contacted, and then when symptoms really start developing, it's too late. I'm Steven North. I specialize in medical malpractice litigation. My office is located in a town house, in the upper east side of Manhattan. We welcome your call.

Is there a statute of limitations on cancer misdiagnosis lawsuits?

Steven E. North

The statute of limitations in New York for all medical malpractice lawsuits -- with some exception that we won't go into -- is 2-1/2 years. But in cancer cases it's tricky because if somebody had a mammogram, for example, two years ago and didn't know that there was a lesion on there -- that there was cancer on there that wasn't picked up -- and then they find out about it just close to that statute of limitations, they have to put that in suit right away. New York does not have a discovery rule that from the time of discovery the statute runs. It runs from the last treatment by the doctor, and one has to be specially careful in cancer cases. I'm Steven (sp?) North. I specialize in medical malpractice litigation. My office is located in a townhouse in the Upper East Side of Manhattan. We welcome your call.

Who do I sue after anesthesia negligence?

Steven E. North

Often when there’s anesthesia malpractice in New York, the anesthesiologist is the prime party that is sued. And in order to determine exactly who the anesthesiologist and/or the assistant, the medical records have to be obtained and reviewed and the persons identified. Often the hospital as well will be a party to that lawsuit. And sometimes the surgeon too, depending upon the circumstances. There are people in that operating room, and if one isn’t paying attention, others should be paying attention. So that responsibility is sometimes a shared responsibility by all the healthcare providers in that operative suite. I’m Steven North, I specialize in medical malpractice litigation. My office is located in a townhouse in the upper east side of Manhattan. We welcome your call.

What are some common examples of hospital negligence?

Steven E. North

There are many incidences of hospital negligence in New York. I have a case where a nurse rather than giving medicine once a week, gave it once a day. That ended in the death of the patient. I have a case where a patient caught on fire in the operating room. There are instances where technicians don't act as they should. Or even in the emergency department, the doctors there are a function of the hospital and if there are errors in the emergency department ordinarily the hospital will be responsible for that. I'm Steven North, I specialize in medical malpractice litigation, my office is located in a town house on the Upper East Side of Manhattan, we welcome your call.
