Are child safety seat defects common?

Thomas M. Kiley and Associates, LLP

Over the last decade or so there have been tremendous advances in the design of child seats. They are much safer today than they were two decades ago. But, still every once in a while, we come across one that is fully designed or is defective and it allows the child to be in the vehicle basically unrestrained and many times ejected with serious consequences. I'm attorney Tom Kiley. I've been representing the seriously injured and their families in Massachusetts for over three decades.

What are some common child safety hazards in cars?

Thomas M. Kiley and Associates, LLP

With respect to automobile safety, there are particular hazards that apply to children. They have to be restrained. Many times there are defective seat belts that upon impact release and the child is ejected from the vehicle. Or they are sitting in a child safety seat, that's inadequately designed or a manufacturing flaw, that will allow the child to be ejected from the vehicle. Once a child is ejected from a vehicle, the seriousness of the injuries increase dramatically because the child does not have the safety of being contained within the vehicle itself. These injures many times devastating. If they don't cause death they can cause spinal cord injury, brain injury or paralysis. I'm attorney Tom Kiley. I've been representing the seriously injured and their families, in Massachusetts, for over three decades.
